ABSTRACT

Notaries as officials have the authority to make authentic deeds as well as other authorities as regulated in Law Number 2 of 2014 concerning Notary Position Regulations. Notaries are responsible for what is witnessed, seen, and also carried out by the notary himself as a public official who carries out his position. This research is a normative research with a descriptive analytical approach to legislation. The purpose of this research is to examine and further analyze the validity of the notarial deed made based on forged documents by the appearers. The results of the study indicate that the making of a Power of Attorney based on a forged document is null and void and the Notary is not responsible if the appearers provide false documents because the notary is not obliged to investigate materially about everything presented by the appearers.
